These terms apply to all ballistic products, including ballistic vests, hard and soft armor plates and panels, ballistic helmets and ballistic shields (“body armor”), purchased from Chief Miller LLC, doing business as Chief Miller Apparel (“Chief Miller Apparel,” “we,” “us” or “our”).

Purchaser Eligibility

Chief Miller Apparel does not perform background checks for body armor purchases. By placing an order, you certify that:

• You are at least 18 years old.
• You have not been convicted of a felony that is a crime of violence, or of any other offense that would prohibit you from purchasing, owning or possessing body armor under federal, state or local law.
• You will not use this product for any criminal or unlawful purpose.
• You are legally allowed to buy, own, possess and wear body armor where you live and wherever you will use it.

It is solely the purchaser’s responsibility to know and follow all federal, state and local laws on buying, owning, possessing, transporting and wearing body armor. Laws vary by state, some places restrict when and where body armor may be worn, and many add penalties for wearing body armor while committing a crime. Chief Miller Apparel may cancel any order, request verification or refuse any sale at its sole discretion.

Shipping Restrictions

We do not sell or ship body armor to New York or Connecticut. Both states require body armor sales to be completed in person. Limited exceptions apply to verified government agency purchases, and these must be approved by Chief Miller Apparel before an order is placed. Please contact us before ordering if you believe an exception applies.

Export Restrictions

Body armor is controlled under U.S. export laws, including the Export Administration Regulations (EAR) and, for some products, the International Traffic in Arms Regulations (ITAR). We ship body armor only to addresses within the United States. You agree not to export, re-export, ship, carry or transfer this product outside the United States, or to any foreign person, without required U.S. government authorization.

Returns – 10-Day Return Window

You may return body armor within 10 days of delivery. To qualify for a return:

• Contact us within 10 days of delivery to request a return authorization before sending anything back.
• The item must be unworn, unused, undamaged and in new condition.
• The item must be in its original packaging with all tags, labels, ballistic panels or plates and accessories included.
• Ballistic panels or plates must not have been removed from sealed packaging, altered, marked, washed or exposed to moisture, heat or impact.

The customer is responsible for return shipping costs, and we recommend a tracked, insured shipping method. Once we receive and inspect the item, approved refunds are issued to the original payment method within 7 business days. Original shipping charges are not refundable. Returns after the 10-day window, returns without authorization, and items that fail inspection will not be accepted and will be sent back at your expense.

Defective or incorrect items: If you receive an item that is defective or not what you ordered, contact us within 10 days of delivery. We will repair it, replace it or issue a refund at no shipping cost to you.

Because worn, used or tampered body armor cannot be safely resold, all inspection decisions by Chief Miller Apparel are final.

Protection Limitations

No ballistic panel, plate, vest, helmet, shield, carrier or other protective gear is 100% bulletproof. Body armor is rated to stop only specific threats and may be defeated by:

• Rifle rounds, including pistol-caliber ammunition fired from a rifle-length barrel
• High-velocity or armor-piercing ammunition
• Edged or pointed weapons such as knives or ice picks, unless the product is specifically rated for them
• Hits outside the protected area, or multiple hits
• Damage, wear, improper fit, improper care, or use past the manufacturer’s service life

Body armor reduces risk. It does not eliminate risk of injury or death. Product descriptions, images and videos are informational only and do not guarantee any level of protection.

Reseller Status

Chief Miller Apparel is an independent authorized retailer and reseller of ballistic and body armor products. We are not the manufacturer. We do not design, engineer, manufacture, test, certify or modify any ballistic panel, plate, vest, helmet, shield or carrier we sell. Protection ratings, certifications (including NIJ compliance), materials, specifications, service life and performance claims are provided by the manufacturer and are not independently verified by us. Products are sold in the manufacturer’s original condition and packaging, without alteration.

To the fullest extent permitted by law, Chief Miller Apparel assumes no responsibility or liability for the design, manufacture, testing, certification, labeling or performance of any ballistic product. Warranty claims, product defect claims and performance claims must be directed to the manufacturer under the manufacturer’s warranty. Chief Miller Apparel may help you contact the manufacturer as a courtesy, but doing so does not make us responsible for the claim.

Disclaimer of Warranties

Chief Miller Apparel sells this product “AS IS” and “WITH ALL FAULTS.” Any warranty comes only from the manufacturer, if applicable, and Chief Miller Apparel does not adopt or assume that warranty. To the fullest extent permitted by law, Chief Miller Apparel makes no warranty of its own, express or implied, and disclaims all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. No employee, agent or representative may create a warranty or assume any liability on our behalf, and there are no oral agreements or collateral warranties. You assume the entire risk as to the product’s quality and performance.

Limitation of Liability

To the fullest extent permitted by law, Chief Miller Apparel and its owners, officers, employees and affiliates will not be liable for any indirect, incidental, special, economic or consequential damages, including lost profits or any loss caused by the product’s failure to perform, whether the claim is based on warranty, contract, negligence, tort or any other legal theory. Our total liability for any claim will not exceed the purchase price of the product, and our only obligation for a defective product is to repair it, replace it or refund the purchase price. We are not an insurer. Some states do not allow certain warranty disclaimers or damage limitations, so some of these limits may not apply to you.

Assumption of Risk and Indemnification

You assume all risks associated with the use and misuse of this product. To the fullest extent permitted by law, you agree to release, indemnify and hold harmless Chief Miller Apparel and its owners, officers, employees and affiliates from any claims, damages, injury or death arising from your purchase, possession or use of the product, or from your violation of these terms or any law.

Dispute Resolution

Any dispute arising from your purchase will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, except that either party may bring an individual claim in small claims court if it qualifies. You agree to bring claims only on an individual basis and not as part of any class or representative action. Arbitration or any permitted court action will take place in Mobile County, Alabama. These terms are governed by the laws of the State of Alabama and applicable federal law.

General

If any part of these terms is found invalid or unenforceable, the remaining terms stay in effect. Headings are for convenience only. By placing an order, you acknowledge that you have read, understood and agreed to these terms.
